I, me, Kim Wade, Gatewood, a living Man, a living soul, hereinafter Secured Party, the undersigned one of We the People, Sovereigns, natural born living soul, the Posterity, born upon the Land of Texas a Republic in one of several counties within one of the presumed several States United of America, the undersigned Posterity, Creditors, Claimants, and Secured Party, hereinafter, Secured Party, do hereby solemnly declare, say and state: I am of majority and competent to state the matters set forth herein; I being of age have first hand knowledge of the facts stated herein; all the facts stated herein are true, correct, complete, not misleading and certain, admissible as evidence, and if testifying I, me, Kim Wade, Gatewood the Secured Party shall so state.                                                                                                   1 of 5                          Plain statement of Facts.

I, me, Kim Wade, Gatewood Secured Party am expressing truth by this Verified Declaration in the Nature of an Affidavit for Truth in Commerce and Contract for Waiver of Tort Presented by me, Kim Wade, Gatewood , living Man, living soul, the Secured Party, one of We the People under Original Common Law Jurisdiction of the Texas Constitution and Constitution for the united States of America, Contracts.

Whereas; the public record is the highest form of evidence, I, me, Kim Wade, Gatewood Secured Party, am hereby timely creating public record by Declaration with this Verified Declaration in the Nature of an Affidavit for Truth in Commerce and Contract for Waiver of Tort Presented by me, Kim Wade, Gatewood, living Man, living soul, the Secured Party, one of We the people under original Common Law Jurisdiction of the Texas Constitution and the Constitution for the united States of America, Contracts.

1. Fact: The person and name known as KIM WADE GATEWOOD, KIM GATEWOOD, KIM W. GATEWOOD and any/all derivatives thereof being and/or fiction(s) (hereinafter OFICTIONO(S): without form or substance, and without any resemblance to any natural born body living or dead, and is entirely an intentional commercial fraud by acts of Genocide of We the People of Texas by the alleged de facto Government officials and Agents of the nul tiel Commercial Corporation(s) Doing business as the UNITED STATES, U.S.A., INC, USA, US, GOVERNMENT OF WASHINGTON D.C./ FEDERAL RESERVE SYSTEM/ DEPARTMENT OF TREASURY-INTERNAL REVENUE SERVICE-BUREAU OF ALCOHOL TOBACCO AND FIREARMS {BATF}/ FEDERAL BUREAU OF INVESTIGATION {FBI}, STATE OF TEXAS with subdivisions being MUNICIPAL COUNTY (IES) and MUNICIPAL CITY(IES). The FICTION is created for the purpose of disfranchising the living Man, living soul, Kim Wade Gatewood of Life, Liberty, Property, and Pursuit of Happiness for the unjust enrichment of the UNITED STATES, U.S.A., INC, U.S.A.,US, GOVERNMENT OF WASHINGTON D.C./ FEDERAL RESERVE SYSTEM/ DEPARTMENT OF TREASURY-INTERNAL REVENUE SERVICE-BUREAU OF ALCOHOL TOBACCO AND FIREARMS {BATF}/ FEDERAL BUREAU OF INVESTIGATION {FBI}, STATE OF TEXAS With subdivisions being MUNICIPAL COUNTY(IES) and MUNICIPAL CITY(IES). The FICTION(S) and its appointed and elected administrators, officers and agents are creating Fictitious civil jurisdiction using their Texas Rules of Civil procedure rule 52,outside the authority of Law and Courts of original jurisdiction.

Fact I, me, Myself, Kim Wade, Gatewood have placed a copyright and trade mark, which is now placed on the name and FICTION known as KIM WADE GATEWOOD, KIM GATEWOOD, KIM W. GATEWOOD and any/all derivatives thereof, nunc pro tunc July 16, 1964, and it is now the private property of Kim Wade, Gatewood and cannot be used without my prior written consent and then only under the terms set out in this contract. The FICTION is my perfected security and registered by contract with me and with the Secretary of State of Texas as such for five years and is my recorded copyright trademark FICTION by this declaration under original Common Law Jurisdiction for (100) years and is the private property of me, I, myself, Kim Wade, Gatewood  the secured Party, for the protection of my Estate, my Life,  Liberty, and Property and Pursuit of Happiness.

3. Fact, Any indentures, debentures, bonds, securities, judgements, warrants or any other kind of commercial paper issued or predicated on the name or FICTION KIM WADE GATEWOOD, KIM W. GATEWOOD, KIM GATEWOOD and any/all derivatives thereof, not excluding birth certificate registration number XXXXXXXX filed with the Texas Department of Health, Bureau  of Vital Statistics and not excluding birth certificate filed at the Bailey County Courthouse, in Muleshoe, Texas on page XXX Volume XX of the records of birth. Social Security No. XXXXXXXXX, Texas Driver License # XXXXXXX, are hereby declared fraudulent, null and void. I, me, myself, Kim Wade, Gatewood, the Living Man, living soul, the Secured Party, know by first hand information, that my mother, Zona Ann, Millen Gatewood would never knowingly participate in any illegal or unlawful scheme intended to create fraudulent commercial paper of any kind and I know by first hand knowledge that my mother never received any benefit nor was paid any consideration for the birth certificate, registration number XXXXXXXX nor for the birth certificate filed at the Bailey County Courthouse, in Muleshoe, Texas on page XXX Volume XX of the records of birth, and I declare that neither her authorized signature nor the signature of her authorized agent appears on the birth certificate, registration number XXXXXX nor on the birth certificate filed at the Bailey County Courthouse, in Muleshoe, Texas on page XXX Volume XX of the records of birth.

4. Fact, Use of the name or FICTION, KIM WADE GATEWOOD, KIM GATEWOOD, KIM W. GATEWOOD, and any/all derivatives thereof, on any document associated in any manner with I, me, myself, my Estate, my name, Kim Wade, Gatewood, living Man, living soul, the holder in due course, Secured Party, without my prior written consent is strictly forbidden and chargeable to each user and issuer in the amount of the sum certain of One Million ($1,000,000.00) dollars in lawful Constitutional money of the United States, Pursuant to Article 1, Section 10 of We the Peoples Contract/ Constitution for the united States of America per user per FICTION and multiplied by the times the copyrighted and trade name/ trademark FICTION is used including any past, present or future use.

5. Fact, Any Unauthorized  possession or use of the name or FICTION, KIM WADE GATEWOOD, KIM GATEWOOD, KIM W. GATEWOOD, and any/all derivatives thereof, is a violation of Section 32.51. The Texas Penal Code for Fraudulent Use or Possession of Identifying Information punishable by up to two years imprisonment in the County jail. Counterfeiting of the trademark KIM WADE GATEWOOD, KIM GATEWOOD, KIM W. GATEWOOD and any/all derivatives thereof, is in violation of Section 32.23. Of the Texas Penal Code and punishable by up to 99 years in state prison and is a violation of Title 18 U.S.C. Crimes and Criminal Procedure, Part one, Ch. 113. Stolen Property Section 2319. Criminal infringement of a copyright.   3 of 5       6. Fact, Any use of the name or FICTION, KIM WADE GATEWOOD, KIM GATEWOOD, KIM W. GATEWOOD and any/all derivatives thereof, with or without scienter of any person, man, woman or any others at the expense of my Rights, Liberty, Property or any part of my Estate and my name without full disclosure and written prior consent is strictly forbidden and chargeable to each of the users and issuers in the amount of the sum certain of one million ($1,000,000.00) dollars of  silver specie in lawful money of the united States of America not limited to any past, present or future for each instance of the said unauthorized use.

7. Fact, Use of the name or FICTION, KIM WADE GATEWOOD, KIM GATEWOOD, KIM W. GATEWOOD and any/all derivatives thereof, on any document associated in any manner with  I, me, myself, my Estate, or name, Kim Wade, Gatewood, the living Man, living soul, the holder in due course, Secured Party without my written prior consent is all of the evidence required for enforcement of this agreement/contract and evidence that any and all users and issuers are in full agreement and have accepted agreement/contract under the condition and terms so stated and set forth herein and is due and payable under the terms and conditions set forth herein this agreement/contract. All violators will be Noticed by this document.

I, me, myself, Kim Wade, Gatewood, the living Man, living soul, holder in due course, Secured Party, am not an expert in the Law, however I do know right from wrong. If there is any human being that is being unjustly damaged by any of the statements herein, if he/she will inform me by facts, I will sincerely make every effort to amend my ways. I hereby and herein reserve the right to amend and make amendment to this document as necessary in order that the truth may be ascertained and proceeding justly determined. If any living soul has information that will controvert and overcome this Declaration, since this is a commercial matter, please advise me IN WRITING by DECLARATION/ AFFIDAVIT FORM within ten (10) days from recording thereof, providing me with your counter Declaration/ Affidavit, proving with particularity by stating all requisite actual evidentiary fact and all requisite actual law, and not merely the ultimate facts of conclusions of law that this Affidavit by Declaration is substantially and materially false sufficiently to change materially my or the FICTIONS status and factual Declaration. Your silence stands as consent to, and tacit approval of, the factual Declarations here being established as fact as a matter of law and this Affidavit by Declaration will stand as final judgement in this matter; and for the sum certain herein stated and will be in full force and effect against all parties, due and payable and enforceable by law. The criminal penalties for commercial fraud to be determined by jury, by the law, the monetary value is set by me for violation of my rights and for breach of the law the contract the Constitutions in the amount of sum certain stated herein for dollars specie of silver coin lawful money of the united States of America as defined by Article 1, Section 10 of the Constitution of We the people for the united States of America and will be due payable on the tenth (10) day or any day there after as use occurs after as use occurs after filing by I, me , myself, in the public records of the county of Lubbock, Texas, of this declaration.

The Undersigned, I me, Myself, the Secured Party, holder in due course of original do herewith declare, state and say that I, Secured Party, issue this with sincere intent in truth, that I, me, myself, the undersigned Secured Party, am competent to state the matters set forth herein, that the contents are true, correct, complete, and certain, admissible as evidence, and reasonable and just to the best of my knowledge by me undersigned addressee.
